The guests report that over 11,000 ACA-based removal orders were issued between November 2024 and January 2025, far exceeding any realistic capacity these countries have to process asylum claims. While the administration has paused some ACA-based pretermissions, thousands of people remain in legal limbo, facing prolonged detention, loss of work permits, or pressure to abandon their claims entirely. Both Hogan and Habib stress that what is occurring constitutes refoulement—the prohibited practice of returning people to places where they face persecution. They outline potential reforms: routing all asylum cases through asylum officers first, expanding legal pathways for protection, restoring the refugee program, and providing legal representation to indigent asylum seekers.
